The controversy began in 2022 when Consumer Reports published a study on harmful chemicals in chocolate. The report revealed alarmingly high levels of lead in Lindt’s Excellence Dark Chocolate 85% Cocoa and excessive cadmium in its Excellence Dark Chocolate 70% Cocoa. While Lindt wasn’t the only brand cited, it became the focus of a class action lawsuit filed in 2023 by a group of U.S. consumers.
The lawsuit accused Lindt of misleading advertising and violating labeling regulations in multiple states, including California, Florida, and New York. Plaintiffs argued they were deceived into paying premium prices for chocolate marketed as “expertly crafted” and “excellent,” despite its alleged chemical content.
The “Puffery” Defense
To counter the claims, Lindt’s lawyers argued that phrases like “excellence” and “expertly crafted with the finest ingredients” were mere “puffery.” Defined as exaggerated and boastful advertising that no reasonable buyer would take literally, the term was intended as a legal strategy to dismiss the case.
This defense, however, backfired. Critics argued it undermined Lindt’s brand reputation, suggesting either the company believed its customers weren’t “reasonable” or its products weren’t as premium as advertised. Social media users and Swiss outlets like NZZ am Sonntag quickly seized on the irony, with the latter describing Lindt’s quality claims as a “transparent marketing masquerade.”
Lindt’s Response
In an attempt to clarify its stance, Lindt emphasized that the “puffery” defense was a legal technicality, not an admission of inferior quality. A company representative stated that the language aimed to demonstrate that the advertising in question wasn’t objective enough to support false advertising claims. Lindt also reaffirmed its commitment to quality, asserting, “Our consumers can have full confidence that our products are expertly crafted with the finest ingredients.”
